Worker Classification:
Getting it Right the 1st Time

Classifying workers correctly is problematic for employers and difficult for the IRS to deal with. While some employers abuse the law, others inadvertently misclassify their workers as independent contractors due to misinterpretation of the law or sometimes because of bad advice from tax professionals. Regardless, the IRS has no sympathy when they conduct an examination and discover worker classification issues. Employers who get it wrong may face large tax liabilities including a Trust Fund Penalty, and tax professionals who give bad advice may also face consequences. Now more than ever, worker classification is important due to the new IRC §199A. This presentation will provide information and tax law to help your clients properly classify their workers and assist them if they get audited by the IRS or State Labor Agencies for employment issues. Andrew uses real world case studies to foster dialogue and create a great learning environment for all participants. He has published articles on worker classification, statutory employees, voluntary classification settlement program, and represents employers for federal and state employment audits and investigations.

Tax Cuts & Jobs Act of 2017: Changes in the Tax Code (Earn 4 CPE hours)

The Tax Cuts and Jobs Act has brought major changes to the tax code. While the individual income tax changes might create simplicity for millions of taxpayers, the business income tax changes are far from simple. Andrew will present a wide array of tax law changes effective January 2018 that will impact everyone from wage earners, homeowners, small businesses, and freelancers, among others. The presentation will provide tax law and case studies on individual tax changes, and the new IRC §199A and §1400Z. IRC §199A created the 20% Qualified Business Income Deduction from which small business owners and self-employed can benefit. IRC §1400Z, brought about the Opportunity Zone Fund, a recommendation that Andrew made to Congress in his 11-page tax reform proposal, will revitalize inner cities and poor communities, and will impact real estate investors, realtors, and contractors. The Tax Cuts and Jobs Act brought about the biggest tax reform in nearly 50 years, and this exciting presentation will provide the information you need to assist your clients during the 2019 filing season.

Course Description: Course Description: The Drake Software Regional Update School provides the latest software and industry information while enabling Drake clients to network with other tax professionals. This school has 5 unique courses:

Day 1 – Worker Classification: Getting it Right the 1st Time – 2 CPE credits – Ethics Dilemmas – Regulatory Ethics – 2 CPE credits – Instructor: Andrew Poulos, EA, ABA, ATP; A Day In The Life: Tax Return Production – 4 CPE credits – Instructor: Warren Drake. Upon completion of Day 1, participants will:

• Know the intricacies of how to properly classify workers and make the appropriate recommendations to their clients.
• Gain insight through the discussion of various ethical dilemmas and learn where to access additional resources.
• Be able to utilize Drake data entry techniques for more effective software operation and workflow management.
• Better understand the overall tax preparation process using Drake Software, improving productivity and efficiency.

Day 2: 2017 Federal Tax Law Updates 4 CPE credits – Instructor: Andrew Poulos and Drake Software Updates/Tools – 4 CPE credits Instructor: Warren Drake. Upon completion of Day 2, participants will be able to do the following:

CPE Facts: These courses deliver CPE in multiple fields of study. See the chart below for specific CPE awarded for each course of this school. CPE is awarded based on your individual professional designation:

• NASBA – (CPAs) receive up to a total of 16 hours of CPE including 8 hours of Specialized Knowledge and Applications (SK & A), 2 hours of Ethics and 6 hours of Taxes.

• IRS – (EAs and PTIN Holders) receive up to a total of 16 hours of CPE including 10 hours of federal tax topics, 2 hours of Ethics, and 4 hours of Tax Update.

Prerequisites: This course is structured for Drake Software users. The only prerequisite is the desire to develop a working knowledge of how to use Drake Software in preparing tax returns. No advanced preparation is necessary.

Course Policies: Refund requests must be sent in writing to Drake Ventures via mail, fax, or e-mail. Refunds will not be granted by phone. Drake will make a full refund for any request received 10 business days or more before the scheduled start of any school. Any cancellation received 5-9 business days prior to start will receive a 50% refund. No refunds on cancellations less than 5 business days prior to the scheduled start of a school. No refunds will be issued for inclement weather unless the school is canceled by Drake. Videos cannot be substituted for a school cancellation. Warren Drake has been in the middle of the tax industry for over 35 years. As a young man starting out in his career, Warren worked in his father’s tax practice where he learned the complexity of the tax code, processing thousands of returns before the advent of computers.

In 1977, Phil Drake (Warren’s brother) started writing code for a tax software program in an attempt to automate the tax business for their father. Warren quickly became involved in writing computer code as well, and at the beginning of the computer age, we find the beginnings of one of the most successful Tax Software companies in the country, Drake Software.

Over the past 35 years, Warren has participated in the development of the software and the development of the content for much of the instructional material for Drake Software tax professionals. Warren has been the company’s lead instructor, conducting live classroom training, sales presentations and presiding over the annual Update School to inform Drake Software clients about upcoming changes in the tax software and the Tax code for the coming year.

As the exclusive dealer for Drake Software in TN, KY and OH, Warren is a very successful entrepreneur who has taken the same standard of excellence in instruction to his customers. He knows the tax industry and his customers appreciate his tireless dedication to communicating the intricacies of the professional tax practice from substance to practical application.

Warren lives in Franklin, NC with his wife Ronda. They share a love for family, music and the mountains. Andrew G. Poulos EA, ABA, ATP

Andrew G. Poulos, EA, principal of Poulos Accounting & Consulting, Inc., in Atlanta, Ga, works with small businesses and individuals to lower their tax liabilities and represents clients before the IRS for tax controversies.

Andrew has been an adjunct professor for University of North Carolina-Charlotte and Auburn University. He is a contributing author for AccountingWEB, CPA Practice Advisor, Promotional Products Association International, founding tax editor for Reviews.com, and current tax editor for Consumer Affairs. Andrew has been a speaker for the National Society of Accountants, National Association of Tax Professionals and various other organizations.

Andrew served on the National Society of Accountants (NSA) Subject Matter Expert Panel and was involved in developing the Accredited Tax Preparer Exam (ATP). He has been appointed to NSA’s Accredited Tax Advisor Cutscore panel and was one of the committee judges for the Accredited Tax Advisor Exam.

As a nationally recognized tax expert, Andrew frequently appears on ABC, CBS, NBC and Fox News. He has published tax articles in over a dozen accounting and CPA journals, and has been referenced as an expert in TIME, Forbes, The Wall Street Journal, U.S. News & World Report and USA Today, among others.

In 2011, Andrew was featured in Georgia State University’s School of Accountancy inaugural newsletter as one of the University’s successful alumni. He has also been featured in the Atlanta Business Chronicle and Main Street Practitioner. Andrew has served as a director on the board of the Georgia State University School of Accountancy, and as a mentor for the GSU Robinson College of Business Honors Mentorship program.

Andrew is the Founder of Poulos Children’s Cancer Foundation Inc., a 501(c)3 charity, and author of the QuickBooks Ultimate Lesson Guide© DVD, a 16-hour training course teaching the fundamentals of QuickBooks. He received his bachelor’s degree in accounting and real estate from Georgia State University in 1994.
